Triplett Family - Lorna Lee Triplett - page 3 - Divorce Papers

          IT IS HEREBY ORDERED that the said defendant be and he is hereby declared to be in default for want of appearance and the Clerk of the Court is hereby ordered to enter the default according to law, and the Court is hereby ordered to enter the default according to law, and the Court having heard the testimony introduced on behalf of the plaintiff and in support of the allegations contained in the complaint, and the cause having been submitted and the Court having duly considered the law and evidence, and
          It appearing satisfactorily to the Court that each and all of the material allegations and averments in the plaintiff's complaint are true, and the Court hereby finds them to be true and that they are sustained by the testimony, free from exceptions as to it competency, admissibility and sufficiency; and
          It appearing to the Court that the plaintiff is entitled to an Interlocutory Decree of this Court, adjudging that the plaintiff has established grounds for the dissolution of the bonds of matrimony heretofore and now existing between the plaintiff and defendant, and
          The law and the premises being by the Court now understood and fully considered and the Court having found that the defendant, Richard Gordon Hazelton, has been guilty of extreme cruelty toward the plaintiff.
          NOW, THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED and this Court does hereby order, adjudge and decree that the plaintiff, Lorna Lee Hazelton, is entitled to an Interlocutory Decree of this Court, declaring that the plaintiff is entitled to a Divorce from the defendant, Richard Gordon Hazelton, and in pursuance thereof, this Interlocutory Decree is hereby made upon the grounds of the defendant's extreme cruelty toward the plaintiff.
          IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the community property of the parties hereto be awarded as follows: That the plaintiff, Lorna Lee Hazelton, be awarded the household furniture and equipment belonging to the parties hereto; and that

          The above entitled action came on regularly to be heard and tried before the Court, sitting without a jury, on the 3rd day of December, 1947, the plaintiff appearing in person and by one of her attorneys, Elmore Winkler, and the defendant not appearing either in person or by attorney; and it appearing to the Court that the defendant, Richard Gordon Hazelton, was, on the 16th day of November, 1947, in the County of Fresno, State of California, duly served with Summons herein, attached to a copy of the Complaint on file in this cause, and as more particularly appears by the on file in this cause, and as more particularly appears by the return of service on file herein, and the time for answering or otherwise appearing having expired, and no Answer or other appearance having been filed by the defendant, and the affidavit of the plaintiff, Lorna Lee Hazelton, having been filed herein stating that said defendant, Richard Gordon Hazelton, is not in the Military Service of the United States, and the defendant, Richard Gordon Hazelton, being in default for want of appearance, now therefore, on motion of George, Winkler & Gibbs, attorneys for plaintiff,
