Jones Family - James Jones Pension - page

Albany County {so} Elizabeth Denison of Bern County in State aforesaid being duly sworn saya her former name was Spence that she was 70 years of age the 3rd day of July last that she was living at home in her Fathers family at the Littlehoosick Albany Co. now Stephentown Renssalaer Co. And within one mile of the residence of James Jones of the same place now deceased that she was acquainted with said Jones And in the year 1781 he the said Jones came to her Fathers and called for her oldest Brother Nicholas Spencer to go with him as a soldier in the service of his country that Nicholas was willing to go but his Mother objected saying he was young - Jones said then was a majority for it for the enemy or the Indians and Tories were coming down and they must be [met] and when it was found that Nicholas was about to go his mother objected herself to Jones & said now if Nicholas gets killed I shall charge it all to you and you being an officer & going with him I committ his charge to you & you must take care of him when they went or how long from home cannot say numbers harms Nicholas

                                 On the twenty eighth day of June One thousand eight hundred and thirty eight personally appeared Isaac Hoard of the town of Potter in the County of Yates & State aforesaid Aged eighty four who being first sworn according to law doth when his oath Say that he was acquainted with James Jones of Little Hoosick Now Stephentown knew him at the commencement of the American Revolution I know he was in the service of his country at that period- In June 1777 I bore arms, & marched to the North and at or near Fort Ann met with Jones together with all our forces there General Schuyler Commanding, they were retreating before the enemy (Burgoyn's Army) Our forces retreating from place to place (followed by the enemy) until the Bennington Battle and on that memorable day when the British forces there surrendered to General [Stac?] Jones was selected to the command of an scouting party he called on me to go & I went with him on such duty- After that Battle our forces continued on duty until Burgoyn's Army give up in October after how much he Jones served in that year except as above stated I do not know or now recollect- but Jones was in the service anterior to that he enlisted and I think as A sejant, in the spring say March or April 1776 and went immediately to [Sensborough] and there joined our army I was not there myself at the time but I know by common reputation as well as by his statements that he said so join the army, And I do know that he enlisted for that purpose under Lieutenant Obediah Vaughn, [?] officer, My brother David Haard who lived in the same house with me, enlisted at the same time and under the same Officer and went with Jones to the army -David is dead I do not now recollect the name of the Capt. but one Wyncoop was then Colonel and the regiment remained at the north during the whole of that season Jones did not return home until late in the fall or far[e] part of winter- That being an is[festud] district where

Who was the husband of Catherine Jones now of Berlin N.Y. Says he has examined the deposition of Anna Rathbun this day made and herewith attached and can certify and does here by certify to the truths and statements therein named with exception of two uninformed statement the are mentioned to take place at the [?] house concerning the enlistment and the other and the other in which his attentional was called by his Mother- and in addition to that she has said I did on one occasion when brother James went in to the service take a team and carried him to or near Albany to join his [patriots] in arms and I understood to March from there to Schohorry- I cannot say in what year that was or how long before his return-

fully satisfied until I got home from school at night and learned by my parents that the inlistment was but for nine months- He went into the service I did not see him until the nine months [lapsed] and he returned home from the service verry late in the fall as [?] part of  [?] - In what year that nine months service was endured I cannot say for certainty further than to say it was to [face] the battle at Saratoga in which the British army surrendered to the american forces but I think it [was] [?] been the last year before that event, but he was in the service as above stated one [time] before the nine months service as the [having] the small [Peach] I think the first tour must have been in 1775. I have heard him mention the name Allen Colonel Allen- The said James was in the service in the same year of the Saratoga Battle and I believe the whole of that season until some time after the defeat & surrender of Burgoyns Army. In the time of that battle I heard the guns very plain, My mother first called my attention to it She said to me how can you be so playful hark don't you hear the cannon [I] expect the two great armies are now fighting and you have two brothers there they may be killed and if the british are [trying][?] they will March through here and I know not what our fate may be- but the cheering was soon reached us that Burgoyn was defeated and had surrendered his army to the American troops - And in the same fall some time after brothers James and Wm returned home - She said James was afterwards in the service but I believe for a shorter period, and when he was not otherwise in the service he was out in Alarms he was in a district where the Tories and Indians were troublesome

Soldiers, were  under the Jurisdiction of "the Committee of Safety of the City & County of Albany". This enlistment was for 9 months.
     It is alleged that Captain Niles died shortly after Jones became an Ensign, and this may account for the circumstance that Jones's name was not returned on Nile's Rolls.
     I also enclose proof that "James Jones" served under Col. Van Schaick for 2 or 5 months in 1780, but am unable to determine whethin this proof is applicable in the present application, as I know not what is declared for in the year 1780, - the affidavit of [Foliard], Enclosed, names [Parting] as his Colonel during said year 1780.
     Moses Bishop testifies to his service in 1777, and thinks he acted as an Ensign (probably only as Commandant of a detachment) in 1776, while engaged in throwing up breast works [?]. He also testifies to his service in 1775, and gives Colonel Mc. Dougall & Captain Lyon as his officers.
     Mc.Dougall & Lyon did serve in the northern campaign of 1775, but I have no documents at hand to prove this.
     I trust however that under all the circumstances of the case, you will find reason to award the widow at least a minimum

Sir/.    
       The claim of Catharine Jones, widow of James Jones, under the act of 4th July 1836, has recently been placed in my hands. The former agent, George R. Davis Esq. of Troy (N.Y.) was unable to give me any information about this claim, except what I could gather from a letter you had addressed him under date of July 24th 1838.
               Although asserted & believed that James Jones was an officer (an Ensign) during a part of the War, I can find no documentary evidence of the fact. He may however, have served as an Ensign without a regular commission.
              He hailed from the same part of the Country with Fisher, Young, and the others named in the paper marked A, herewith sent; and I present this paper giving the name of Jones as an Enlisted Soldier under said officers, in June 1775, under the conviction that the James Jones whose name appears to that paper is the same James Jones, whose widow applies for a pension. All those whose names are subscribed to said paper as voluntarily enlisted

We the subscribers being well convinced of the absolute necesity of raising a sufficient body of provincial forces for the defence of the Constitution and the preservation of our Just Rights and liberties when the same are in the most imment danger of being invaded have therefore voluntarily militia unto the Provincial Service under Capt. John Kisher B[?] Evans first Lieut. & Joseph Fitch 2o. [?] & Guy Young Ensign, and do hereby promise and agree that we will severally do execute and perform all and every such Instructions directions orders and military discipline and duties as our said officers or either of them or the commanding officer for thetime being on this new establishment shall from time to time give or send to us during the time that our service is required in the unhappy contest between Great Britian and the Colonies and we do [?] promise and engage not to go from or quit the said service untill we shall be discharged or dismissed from the same by the Continental Congress or the Provincial Congress of this colony or by the General Committee of the City & County of Albany under the penalty of forfeiting our wages and being deemed in the eye of the publick as enemies to our Country and we the said officers do severally promise and [agage] under the most solemn ties of honor and love to our Country that we shall and will from time to time and at all times during the said Contest between Great Britian and the said United Colonies to perform and execute in our several and respective Stations all and every the Instructions directions orders Millitary disipline and duties as the

[asserted] improperly that Jones might not have been a regular commissioned officer. There is record proof of the fact; to wit of service under Capt. Niles in 1779 & 1780, and the same is enclosed (pound 14.3:9) merely 3 months service I believe.
      Claiming principally for service in 1775, 1779, & 1780, both fortified by record & [?] proof, 1775, 1779, & 1780, both fortified by record & [?] proof, we confidently trust that [?] of the claim will induce a favorable decision. The proof of marriage is admitted to[?] purfict.

In the Case of Catharine
Jones widow of James Jones, if the service of Jones as Sergeant in 1775 added to his service as Lieutenant after [or in] 1779 amounting to more than 2 months refer in enclosed certificate from the Comptroller of the State of New York do not make out 6 months, I am not disposed to prosecute this claim any farther. In your letter of July 1838 you say that "there is not evidence in the Department that James Jones was an officer in the Drafts" of 5 mos. morein 1776 of 4 mos morein 1777 & 3 mons more in 1778. I am aware that no direct proof has been furnished to establish any portion of this service, nor do we claim for such service - only for service previous prior to 1779 in the year 1775 of 9 months. We do not claim that Jones was a commissioned officer previous to 1779.
      Of the 9 months service of Jones in 1775 you have documentary evidence in your office, & the same is confirmed bythe affidavit of [Births] - This service was rendered under Col. McDougale & Capt. Lyon.
          In my last communication not then sufficiently understanding this claim, I

To James Jones Gentleman      

By virtue of the Authority reposed in us, We do hereby nominate, authorize, constitute and appoint you the Said James Jones
                     Ensign of the forth Company of Militia of foot in the forth Regement in the County of Albeny where of [?] James Denison [?], Captain her[by] requiring you, before you enter into the Exercise of your said Office, to make in Writing, [a]nd subscribe in Prefence of the [c]hairman of the Committee of the City, Town, District, or Precinct wherein you reside, the Declaration appointed and directed by the Eleventh Section of the Seventh Resolve contained in the Rules and Orders for regulating the Militia of the Colony of New-York, recommended by this Congress on the 22d Day of August 1775, and authorizing you fully to execute all the Powers belonging to your said Office, by virtue of the said Rules and Orders and the said Declaration : And we do hereby require all Persons under your Command, to pay due Obedience to you, according to the said Rules and Orders, and such further Rules and Orders as shall be made and recommended for the Militia of this Colony, by the present, or any future Continental Congress, or Provincial Congress of this Colony.

                      To James Jones Gent. Greeting

We reposing especial Trust and Confidence, as well in your Patriotism, Conduct and Loyalty, as in your Valour and readings to do us good and faithful Service. Have appointed and constituted, and by these Presents Do Appoint and Constitute you the Said James Jones Ensign of Captain James Dennisons Company of militia for the County of Albany in the Regiment where of Killian Van Rensselaer Esquire is Colonel You are therefore, to take the said Company into your charge and care as Ensign thereof and duly to exercise the Officers and Soldiers of that Company in Arms, who are hereby commanded to obey you as their Ensign and you are also to Observe and follow such Orders and Directions, as you shall from time to time receive from our General and Commander in chief of their Militia of our said State, of any other your Superior Officer, According to the Rules and dicipline of War in pursuance of the Trust reposed in you; and forsodoing this shall be Your Commission. for and during our good pleasure to be Signified by our Council of appointment. In Testimony whereof, we have caused our Seal for Military Commissions to be hereunto Affisced.
