Greene Family - David Green - Estate Papers


I do not know when this picture was taken. There are 2 possibilities:
1. It was taken in Barry or Pittsfield Illinois.
2. It was taken in St Louis Missouri where he died in 1865. I can't make up my mind. It could be a post mortem picture........

To the Sheriff of Said County ---GREETING:
    WHEREAS, It appears to the County Court of said County, by inspection of the General Docket and Records of said Court, that Jerusha Green Executrix of the estate of David Green deceased, has failed to render settlement of  her Executorship therein as by statute provided And whereas Citation has been issued to the said Jerusha Green and returned "not served" the said Jerusha Green being dead, and whereas it appears that Joseph Green is the security on the official Bond of the said Jerusha Green,
    YOU are, therefore, hereby commanded that you cite and give notice to the said Joseph Green, as aforesaid, that he bo and appear before the County Court of Pike County, at a regular term thereof, to be holden at the Court House, in Pittsfield, on the third Monday of July A.D. 1873, then and there to show cause, if any why said estate should not be finally settled, and no order ordered discharging he as such and why an Administrator with the [will]annexed to make such final settlement
and further to do and perform what shall then be said Court, be required and adjudged.
    And hereof make due service and return as the law directs.

Know all Men by these Presents:
THAT WE,  Jerusha Green and Joseph Green
Of the County of Pike and State of Illinois, are held and firmly bound unto the people of the State of Illinois, in the penal sum of Five Thousand Dollars, current money of the United States, which payment well and truly to be made and performed, we and each of us bind ourselves, our heirs, executors and administrators, jointly severally and firmly by these presents. Witness our hands and seals, this 20 day of June A.D. 1865.
           THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, T if the above bound Jerusha Green Executrix or the last Will and Testament of David Green deceased do make or cause to be made, a true and perfect inventory of all and singular the goods and chattels, rights and credits, lands, tenement and herditaments, and the rents and profits issuing our of the same, of the said deceased which or shall come to the hands possession or knowledge of the said Jerusha Green or into the possession of any other person for her and the same so made do exhibit in the County Court for the said County of Pike as required by law; and also make and render a fair and just account of her as actings and doings as such Executrix to said Court, when thereunto lawfully required, and to well and truly fulfill the duties enjoined upon her in and by the said Will; and shall, moreover, pay and deliver to the persons entitled thereto, all the legacies and bequests contained in said Will; so far as the estate of said testator will thereunto extend, according to the value thereof, and as the law shall charge and shall in general do all other acts which may from time to time be required of by law, then this obligation to be void; otherwise to remain in full force and virtues.

Know all men by these Present That I David Green of The County of Pike annd State of Illinois Do hereby Declair this my last will to be in the form and manner folowing viz

    First That all of my Just Debts be paid as soon after my demise as can be [?] done.
    Second To my Wife Jerusha Green I give and Bequeth All of my Estate both Real Personal & mix & of any  {?]That may remain after my debts ar paid
    Third I also apoint my Wife my Executrix to this my last Will and Testament Revoking all former Wills by me made {/} and confirming this and this only by a fixing my Seal there to This Seventh day of may in the Year of Our Lord one thousand Eight and fifty three.

                                            In Probate, June Term, A.D. 1865
PERSONALLY APPEARED in open Court, B.D. Brown and S R Whitaker subscribing witnesses to the foregoing instrument of writing, purporting to be the LAST WILL AND TESTAMENT of David Green late of Pike County, deceased, who being duly sworn according to law, doth depose and say, each for himself, that the foregoing is the Last Will and Testament of the said David Green deceased; that they subscribed their names thereto as the attesting witness at the request of the said Testator, and in May A.D. 1853. That he then and there subscribed his name thereto in our presence, and declared the same to be his Last Will and Testament; and that the said Testator at the time of executing the same as aforesaid was of full age, of sound mind and memory, and under no constraint.

    I do solemnly swear, that this writing contains the true last will and testament of the within named David Green deceased, so far as I know or believe, and his goods, chattels will thereunto extend, and the law charge me; and that I will well and truly execute the same, by paying first the debts and then the legacies mentioned therein, as far as his goods, and chattels will thereunto extend and the law charge me; and that I will make a true and perfect inventory of all such goods and chattels, rights, and credits, as may come to my hands or knowledge, belonging to the estate of said deceased and render a fair and just account of my executorship, when thereunto required by law, to the best of my knowledge and abilities, so help me God.
